Threats are Powerful in Negotiating, but Make One of these 2 WRONG Threats and You May NEVER Get a Refund.
Make threats, but be careful.
There are two threats you NEVER want to make.
Regardless of what lies the seller told you, don't ever make one of these two threats. I've even seen attorneys do it and it costs their client dearly. Don't let it happen to you. Number 1, never threaten to file criminal charges. It is ILLEGAL to
threat criminal charges to settle a civil matter. Even though the Seller may have
committed acts that are criminal, (violation of many of the Franchise or Business
Opportunity laws is a criminal action) you cant say, Give me a refund or else I will
report your criminal acts to the proper authorities. If you do this you could find
yourself in serious trouble. You might have to forget about any refund just to keep the
Seller from reporting you. Of course, you could hint by letting the seller know that you know that he has
committed criminal acts, but be VERY careful in this area. Number 2, never say, I have several other people watching the outcome of
this. Ive even seen attorneys make this mistake. Think about it. What
you are telling the Seller is that if he gives you a refund, he will probably have 10 or
100 more people demanding a refund. I know of one company that spent over $30,000 and tied everything up in court for two
years rather than give an $8,000 refund, all because an attorney made the above statement. The proper way to handle this is to do the opposite. Tell the Seller that when
you get your refund, you will never disclose it to anyone. In fact, you will agree to say
that the Seller is a very reputable company and that when differences arise; things are
resolved in a fair and equitable manner. You could even give the Seller a good recommendation because, after all, they did do
the right thing as far as you are concerned.
